Rich Segal is the managing partner of the law firm's San Diego and San Diego North County offices. He has litigated in state, federal and bankruptcy courts on a wide variety of state and federal issues at both the trial and appellate levels. His practice emphasizes commercial and business litigation, with particular concentrations in the retail segment, consumer finance, unfair competition, false advertising, securities, antitrust, banking, accommodations for the disabled in public facilities and employee benefits matters.

Mr. Segal has substantial litigation experience involving the vehicle finance industry. He has successfully represented vehicle finance and leasing companies, including both "captive" and independent companies, in several class actions and private attorney general actions challenging client practices under the federal Consumer Leasing Act, the federal Truth in Lending Act, the California Vehicle Leasing Act and California's Rees-Levering Motor Vehicle Sales and Finance Act. Mr. Segal has also provided compliance advice to vehicle sales companies regarding state statutory, common law and regulatory requirements.

Mr. Segal additionally focuses on representing large retailers in various forms of business litigation specific to the retail industry. He has successfully defended mass merchandizers against allegations of consumer credit card violations, product liability, patent infringement and false advertising, and has advised retail clients in connection with investigations initiated by government regulatory agencies. Mr. Segal has also advised major retailers in consumer class actions alleging violations of the California Invasion of Privacy Act (CIPA) relating to the recording of telephone calls allegedly without consent.

Mr. Segal also has significant experience representing benefit plans and trustees in cases brought under the Employee Retirement Income Security Act of 1974, as amended (ERISA) in courts throughout California. For example, he briefed and argued a case for a trustee bank in the United States District Court for the Southern District of California and the United States Court of Appeals for the Ninth Circuit, which resulted in a published opinion in the bank’s favor (Parker v. Bain, 68 F.3d 1131 (9th Cir. 1995)) establishing several new principles of law in the Ninth Circuit under both the federal Bankruptcy Code and ERISA. He served as trial counsel in federal court on behalf of a client corporation and two of its sponsored retirement plans in a complex ERISA case, obtaining a defense verdict on claims of underpayment of retirement benefits to a former executive.

Other significant matters include his representation of public corporations and/or inside or outside directors in various class action securities cases in the United States District Courts for the Southern District of California and for the District of New Jersey, and in derivative actions in various state and federal courts. Mr. Segal has also represented several large telecommunications companies in actions alleging price fixing and false advertising of their communication products and services.

Mr. Segal currently serves as a Trustee, and is a past President and member of the Board of Directors, of San Diego Youth Services, Inc., a nonprofit social service agency providing for the needs of San Diego's at-risk youth and their families. He is also a member of the National Leadership Council of Lambda Legal. In addition, he is a member of the Board of Directors of the Petco Foundation, a nonprofit charity dedicated to raising the quality of life for pets and their human families. He has in the past served as President of the Yale Club of San Diego, as a member of the Board of Governors of the San Diego chapter of the Association of Business Trial Lawyers, and as a student advisor at the University of California at San Diego.
